These Terms of Use (the “Terms”) govern your use of the “Prototipiamo” website (the “Site”) and its conversational assistant. By using the Site, you accept these Terms.
1. Operator and purpose
“Prototipiamo” is a service of Oxequa S.r.l., with registered office at Via delle Tagliate di San Marco 525, 55100 Lucca (LU), Italy — VAT no. IT02488100468 (“Oxequa”). The Site presents our design and prototyping services and allows you to submit a contact request through the conversational assistant. Contact: info@prototipiamo.com.
2. Eligibility
The service is intended for professionals, businesses and startups, not for consumers. By using the Site, you represent that you are of legal age and that you are acting in the course of your trade, business or profession, and that you have the authority to do so on behalf of the entity you represent. You agree to provide truthful, complete and up-to-date information.
3. Nature of the service and of requests
The Site provides information and allows you to submit a contact request. Submitting a request does not constitute a contract or a binding order: any design or prototyping work will be the subject of a separate quote and agreement, entered into in writing between the parties.
4. Response times
We undertake to provide a quote or an initial response within 24 business hours of receiving a complete request. This is a service target pursued in good faith: any delays due to causes not attributable to Oxequa (e.g. force majeure, incomplete information, unavailability of third-party services) shall not give rise to any liability.
5. Conversational assistant (AI)
The assistant's answers are generated with the aid of artificial intelligence systems and are for information purposes only and merely indicative. They may contain inaccuracies or errors and do not constitute professional advice or a binding offer. Only what Oxequa confirms in writing in the quote or in the contract shall be binding. We encourage you to verify any relevant information before relying on it.
6. User conduct
When using the Site and the assistant, you agree not to:
- submit content that is unlawful, offensive, defamatory or that infringes the rights of others;
- upload materials you do not hold the rights to or that contain malware;
- attempt to compromise the security, integrity or availability of the Site;
- use the service for purposes other than those intended or in a fraudulent manner.
Oxequa may suspend or restrict access in the event of a breach of these Terms or improper use of the service.
7. Intellectual property
The materials you send us (text, images, files) remain your property; you grant us the right to process them solely for the purpose of evaluating and following up on your request. The trademarks, logos, text, graphics, layout and code of the Site are the property of Oxequa S.r.l. (or of their respective owners) and may not be used, reproduced or distributed without written authorization.
8. Confidentiality of your ideas
We know that there is value behind a product idea. What you tell us stays between you and the Oxequa team: we do not sell or disclose your ideas to third parties, and we use them only to evaluate and follow up on your request.
The assistant relies on an artificial intelligence model: your messages are therefore also processed by a specialized technology provider (AI provider), which processes the data on our behalf and in accordance with our instructions, in compliance with the GDPR. The provider operates through APIs that do not use your data to train its models and retain it for a limited period. Data processors, safeguards and transfers outside the EU (SCCs/DPF) are described in the Privacy Policy.
If you prefer to formalize confidentiality before sharing the details (specifications, drawings, technical materials), we will prepare a non-disclosure agreement (NDA) on request: just ask in the chat or write to info@prototipiamo.com and we will get back to you to sign it, without you having to tell us anything in advance.
9. Limitation of liability
The Site and the assistant are provided “as is”, without any warranty of continuity, freedom from errors or fitness for a particular purpose. To the extent permitted by law, Oxequa shall not be liable for any indirect or consequential damages arising from the use of the Site or from reliance on the assistant's answers. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law.
10. Changes to these Terms
Oxequa may update these Terms from time to time: the version in force is always published on this page, together with its last-updated date.
11. Governing law and jurisdiction
These Terms are governed by Italian law. The Court of Lucca (Foro di Lucca), Italy, shall have exclusive jurisdiction over any dispute relating to them, without prejudice to mandatory provisions of law.
